Burger v. State, 231 S.E.2d 769 (Ga. 1977).  Accord Ball v. State, 419 N.E.2d 137 (Ind. 1981). Both of these cases involved murder prosecutions. Perhaps the courts felt that the privilege should be construed more narrowly in this context since the societal need for evidence is correspondingly greater due to the gravity of the crime.
